vedie vn\u00fatorn\u00fd oznamovac\u00ed syst\u00e9m a&nbsp;zais\u0165uje ochranu oznamovate\u013eov na&nbsp;z\u00e1klade pr\u00e1vnych povinnost\u00ed ulo\u017een\u00fdch spolo\u010dnosti ako tzv. povinn\u00e9mu subjektu pod\u013ea z\u00e1kona o&nbsp;ochrane oznamovate\u013eov (\u010falej tie\u017e len \u201eZOCH\u201c).<\/p>\n<p>Na&nbsp;zabezpe\u010denie plnenia povinnost\u00ed pod\u013ea z\u00e1kona o&nbsp;ochrane oznamovate\u013eov bola spolo\u010dnos\u0165ou vydan\u00e1 z\u00e1v\u00e4zn\u00e1 intern\u00e1 smernica o&nbsp;vn\u00fatornom oznamovacom syst\u00e9me a&nbsp;ochrane oznamovate\u013eov (\u010falej tie\u017e len \u201eintern\u00e1 smernica\u201c).<\/p>\n<p>Prostredn\u00edctvom vn\u00fatorn\u00e9ho oznamovacieho syst\u00e9mu spolo\u010dnosti mo\u017eno pri splnen\u00ed stanoven\u00fdch podmienok poda\u0165 na&nbsp;to opr\u00e1vnenou fyzickou osobou (\u010falej tie\u017e len \u201eoznamovate\u013e\u201c) ozn\u00e1menie o&nbsp;protipr\u00e1vnom konan\u00ed, o&nbsp;ktorom sa oznamovate\u013e dozvedel v&nbsp;s\u00favislosti s&nbsp;vykon\u00e1vanou pr\u00e1cou alebo inou obdobnou \u010dinnos\u0165ou pre spolo\u010dnos\u0165 (\u010falej tie\u017e len \u201e ozn\u00e1menie\u201c).<\/p>\n<h2>Ak\u00e9 ozn\u00e1menia o&nbsp;poru\u0161en\u00ed mo\u017eno poda\u0165<\/h2>\n<p>Prostredn\u00edctvom vn\u00fatorn\u00e9ho oznamovacieho syst\u00e9mu mo\u017eno pod\u00e1va\u0165 ozn\u00e1menie o&nbsp;mo\u017enom poru\u0161en\u00ed, ktor\u00e9:<\/p>\n<ul>\n<li>m\u00e1 znaky trestn\u00e9ho \u010dinu,<\/li>\n<li>m\u00e1 znaky priestupku, za ktor\u00fd z\u00e1kon stanovuje sadzbu pokuty, ktorej horn\u00e1 hranica je aspo\u0148 100.000 CZK,<\/li>\n<li>poru\u0161uje z\u00e1kon o&nbsp;ochrane oznamovate\u013eov,<\/li>\n<li>poru\u0161uje in\u00fd pr\u00e1vny predpis alebo predpis Eur\u00f3pskej \u00fanie v&nbsp;oblastiach definovan\u00fdch v&nbsp;z\u00e1kone o&nbsp;ochrane oznamovate\u013eov.<\/li>\n<\/ul>\n<h2>Kto m\u00f4\u017ee ozn\u00e1menie o&nbsp;poru\u0161en\u00ed poda\u0165<\/h2>\n<p>Prostredn\u00edctvom vn\u00fatorn\u00e9ho oznamovacieho syst\u00e9mu m\u00f4\u017eu pod\u00e1va\u0165 ozn\u00e1menia nasleduj\u00face osoby:<\/p>\n<ul>\n<li>osoby v&nbsp;pracovnom pomere,<\/li>\n<li>osoby vykon\u00e1vaj\u00face pr\u00e1cu na&nbsp;z\u00e1klade dohody o&nbsp;pr\u00e1ci vykon\u00e1vanej mimo pracovn\u00e9ho pomeru,<\/li>\n<li>dobrovo\u013en\u00edci,<\/li>\n<li>osoby na&nbsp;odbornej st\u00e1\u017ei \u010di na&nbsp;odbornej praxi.<\/li>\n<\/ul>\n<p>Spolo\u010dnos\u0165 v&nbsp;s\u00falade s&nbsp;ust. \u00a7 9 ods. 2 p\u00edsm. b) bodom 3 z\u00e1kona o&nbsp;ochrane oznamovate\u013eov vylu\u010duje prij\u00edmanie ozn\u00e1men\u00ed od osoby, ktor\u00e1 pre spolo\u010dnos\u0165 nevykon\u00e1va pr\u00e1cu alebo in\u00fa obdobn\u00fa \u010dinnos\u0165 pod\u013ea \u00a7 2 ods. 3 p\u00edsm. a, b), h) alebo i) z\u00e1kona o&nbsp;ochrane oznamovate\u013eov.<\/p>\n<p>Z\u00e1konom o&nbsp;ochrane oznamovate\u013eov ani touto internou smernicou nie je dotknut\u00e1 z\u00e1konn\u00e1 povinnos\u0165 ozn\u00e1mi\u0165 priamo org\u00e1nom \u010dinn\u00fdm v&nbsp;trestnom konan\u00ed tie sp\u00e1chan\u00e9 trestn\u00e9 \u010diny, ktor\u00e9 s\u00fa taxat\u00edvne uveden\u00e9 v&nbsp;ustanoven\u00ed \u00a7 368 TZ a&nbsp;spadaj\u00fa pod&nbsp;tzv. oznamovaciu povinnos\u0165 (napr. vra\u017eda, \u0165a\u017ek\u00e9 ubl\u00ed\u017eenie na&nbsp;zdrav\u00ed ai. .).<\/p>\n<h2>Obsah ozn\u00e1menia<\/h2>\n<p>Ozn\u00e1menie by malo obsahova\u0165 meno, priezvisko, d\u00e1tum narodenia alebo in\u00e9 \u00fadaje, z&nbsp;ktor\u00fdch je mo\u017en\u00e9 vyvodi\u0165 toto\u017enos\u0165 oznamovate\u013ea.<\/p>\n<p>K&nbsp;efekt\u00edvnemu pre\u0161etreniu ozn\u00e1menia je potrebn\u00e9 uvies\u0165 minim\u00e1lne nasleduj\u00face inform\u00e1cie:<\/p>\n<ul>\n<li>identifikova\u0165 osoby podozriv\u00e9 zo sp\u00e1chania poru\u0161enia<\/li>\n<li>opis poru\u0161enia<\/li>\n<li>d\u00f4kazy o&nbsp;poru\u0161en\u00ed a&nbsp;\u010fal\u0161ie podporn\u00e9 poznatky<\/li>\n<\/ul>\n<h2>Mo\u017en\u00e9 sp\u00f4soby podania ozn\u00e1menia o&nbsp;poru\u0161en\u00ed<\/h2>\n<p>Ozn\u00e1menie o&nbsp;poru\u0161en\u00ed je mo\u017en\u00e9 prostredn\u00edctvom vn\u00fatorn\u00e9ho oznamovacieho syst\u00e9mu v&nbsp;spolo\u010dnosti poda\u0165 v&nbsp;s\u00falade s&nbsp;po\u017eiadavkami z\u00e1kona o&nbsp;ochrane oznamovate\u013eov nasleduj\u00facimi sp\u00f4sobmi:<\/p>\n<ul>\n<li>Elektronicky \u2013 na&nbsp;mailov\u00fa adresu whistleblowing@ptc.cz<\/li>\n<li>P\u00edsomne \u200b\u200b\u2013 po\u0161tou na&nbsp;adresu s\u00eddla spolo\u010dnosti, tak\u00fa z\u00e1sielku je potrebn\u00e9 ozna\u010di\u0165 n\u00e1pisom \u201eD\u00f4vern\u00e9, iba k&nbsp;ruk\u00e1m pr\u00edslu\u0161nej osoby\u201c \u010di in\u00fdm obdobn\u00fdm textom,<\/li>\n<li>\u00dastne \u2013 telefonicky na&nbsp;tel. \u010d\u00edsle +420&nbsp;222&nbsp;998&nbsp;926<\/li>\n<li>\u00dastne \u2013 osobne na&nbsp;stretnut\u00ed s&nbsp;Pr\u00edslu\u0161nou osobou, pokia\u013e o&nbsp;to oznamovate\u013e po\u017eiada e-mailom na&nbsp;adrese uvedenej vy\u0161\u0161ie. Pr\u00edslu\u0161n\u00e1 osoba je povinn\u00e1 prija\u0165 ozn\u00e1menie najnesk\u00f4r do 14&nbsp;dn\u00ed od takejto \u017eiadosti.<\/li>\n<\/ul>\n<p>Opakovane podan\u00e9 ozn\u00e1menie od toho ist\u00e9ho oznamovate\u013ea av tej istej veci nie je pr\u00edpustn\u00e9 a&nbsp;nebude znovu pre\u0161etrovan\u00e9 s&nbsp;t\u00fdm, \u017ee oznamovate\u013e o&nbsp;tom bude upovedomen\u00fd s&nbsp;pr\u00edslu\u0161n\u00fdm kr\u00e1tkym od\u00f4vodnen\u00edm. To neplat\u00ed v&nbsp;pr\u00edpade, \u017ee by toto \u010fal\u0161ie ozn\u00e1menie obsahovalo oproti sk\u00f4r podan\u00e9mu ozn\u00e1meniu nov\u00e9 inform\u00e1cie a&nbsp;skuto\u010dnosti.<\/p>\n<h2>Kto je pr\u00edslu\u0161nou osobou na&nbsp;prij\u00edmanie a&nbsp;vybavovanie ozn\u00e1men\u00ed<\/h2>\n<p>Na&nbsp;prijatie ozn\u00e1menia, na&nbsp;posudzovanie jeho d\u00f4vodnosti a&nbsp;na&nbsp;\u010fal\u0161\u00ed s\u00favisiaci postup v&nbsp;r\u00e1mci vn\u00fatorn\u00e9ho oznamovacieho syst\u00e9mu je opr\u00e1vnen\u00e1 v\u00fdhradne pr\u00edslu\u0161n\u00e1 osoba.<\/p>\n<p><strong>Pr\u00edslu\u0161nou osobou v&nbsp;spolo\u010dnosti je:<\/strong><\/p>\n<p>Ing. +420&nbsp;222&nbsp;998&nbsp;926<\/p>\n<p>V&nbsp;r\u00e1mci prij\u00edmania a&nbsp;posudzovania d\u00f4vodnosti ozn\u00e1menia postupuje pr\u00edslu\u0161n\u00e1 osoba v\u017edy samostatne, nez\u00e1visle a&nbsp;nestranne s&nbsp;t\u00fdm, \u017ee je opr\u00e1vnen\u00e1 vy\u017eadova\u0165 od v\u0161etk\u00fdch organiza\u010dn\u00fdch \u00fasekov a&nbsp;v\u0161etk\u00fdch zamestnancov spolo\u010dnosti potrebn\u00e9 inform\u00e1cie a&nbsp;podklady, ako aj in\u00e9 formy s\u00fa\u010dinnosti.<\/p>\n<p>Pr\u00edslu\u0161n\u00e1 osoba pritom zabezpe\u010d\u00ed, aby sa osloven\u00ed zamestnanci nemohli obozn\u00e1mi\u0165 s&nbsp;obsahom ozn\u00e1menia a&nbsp;aby nevy\u0161la najavo \u017eiadna skuto\u010dnos\u0165, ktor\u00e1 by mohla identifikova\u0165 osobu oznamovate\u013ea.<\/p>\n<h2>Lehoty na&nbsp;informovanie oznamovate\u013ea a&nbsp;na&nbsp;pos\u00fadenie d\u00f4vodnosti ozn\u00e1menia<\/h2>\n<p>Pr\u00edslu\u0161n\u00e1 osoba za\u0161le oznamovate\u013eovi upovedomenie o&nbsp;prijat\u00ed ozn\u00e1menia najnesk\u00f4r do siedmich (7) dn\u00ed odo d\u0148a podania ozn\u00e1menia.<\/p>\n<p>To neplat\u00ed iba v&nbsp;pr\u00edpade, ke\u010f:<\/p>\n<p>oznamovate\u013e v\u00fdslovne po\u017eiada pr\u00edslu\u0161n\u00fa osobu, aby ho o&nbsp;prijat\u00ed ozn\u00e1menia nevyrozumievala, alebo je zrejm\u00e9, \u017ee by informovan\u00edm o&nbsp;prijat\u00ed ozn\u00e1menia do\u0161lo k&nbsp;prezradeniu toto\u017enosti oznamovate\u013ea inej osobe.<\/p>\n<p>Pr\u00edslu\u0161n\u00e1 osoba je povinn\u00e1 pos\u00fadi\u0165 d\u00f4vodnos\u0165 ozn\u00e1menia a&nbsp;p\u00edsomne \u200b\u200bupovedomi\u0165 oznamovate\u013ea o&nbsp;v\u00fdsledkoch pos\u00fadenia do tridsiatich (30) dn\u00ed odo d\u0148a prijatia ozn\u00e1menia.<\/p>\n<p>V&nbsp;pr\u00edpadoch skutkovo alebo pr\u00e1vne zlo\u017eit\u00fdch mo\u017eno t\u00fato lehotu pred\u013a\u017ei\u0165 a\u017e o&nbsp;\u010fal\u0161\u00edch tridsa\u0165 (30) dn\u00ed, najviac v\u0161ak dvakr\u00e1t, tj maxim\u00e1lna d\u013a\u017eka pre posudzovanie d\u00f4vodnosti ozn\u00e1menia m\u00f4\u017ee vo v\u00fdnimo\u010dn\u00fdch pr\u00edpadoch by\u0165 dev\u00e4\u0165desiat (90) dn\u00ed odo d\u0148a podania ozn\u00e1menia.<\/p>\n<p>O&nbsp;pred\u013a\u017een\u00ed lehoty a&nbsp;d\u00f4vodoch pre jej pred\u013a\u017eenie pr\u00edslu\u0161n\u00e1 osoba v\u017edy oznamovate\u013ea p\u00edsomne \u200b\u200bupovedom\u00ed e\u0161te pred jej uplynut\u00edm.<\/p>\n<h2>Z\u00e1kaz odvetn\u00fdch opatren\u00ed vo\u010di oznamovate\u013eom<\/h2>\n<p>V&nbsp;r\u00e1mci vedenia vn\u00fatorn\u00e9ho oznamovacieho syst\u00e9mu, ako aj pri s\u00favisiacich alebo \u010fal\u0161\u00edch \u010dinnostiach v\u0161etk\u00fdch zamestnancov a\/alebo \u010dlenov org\u00e1nov spolo\u010dnosti plat\u00ed pr\u00edsny z\u00e1kaz uplat\u0148ovania ak\u00fdchko\u013evek odvetn\u00fdch opatren\u00ed vo\u010di oznamovate\u013eom.<\/p>\n<p>Odvetn\u00fdm opatren\u00edm sa v&nbsp;tomto smere rozumie konanie alebo jeho opomenutie v&nbsp;s\u00favislosti s&nbsp;pr\u00e1cou alebo inou obdobnou \u010dinnos\u0165ou oznamovate\u013ea, ktor\u00e9 bolo vyvolan\u00e9 podan\u00edm ozn\u00e1menia a&nbsp;ktor\u00e9 oznamovate\u013eovi m\u00f4\u017ee sp\u00f4sobi\u0165 ujmu.<\/p>\n<p>Pri splnen\u00ed t\u00fdchto podmienok je odvetn\u00fdm opatren\u00edm napr. rozviazanie pracovn\u00e9ho pomeru alebo nepred\u013a\u017eenie pracovn\u00e9ho pomeru na&nbsp;dobu ur\u010dit\u00fa, zn\u00ed\u017eenie mzdy alebo odmeny alebo nepriznanie osobn\u00e9ho pr\u00edplatku, prelo\u017eenie alebo prevedenie na&nbsp;in\u00fa pr\u00e1cu, neumo\u017enenie odborn\u00e9ho rozvoja, v\u00fdpove\u010f alebo odst\u00fapenie od (obchodnej) zmluvy alebo z\u00e1sah do pr\u00e1va na&nbsp;ochranu osobnosti.<\/p>\n<p>Z\u00e1kaz odvetn\u00fdch opatren\u00ed sa vz\u0165ahuje aj na&nbsp;\u010fal\u0161ie chr\u00e1nen\u00e9 osoby uveden\u00e9 v&nbsp;\u00a7 4 ods. 2 ZOCH, najm\u00e4 na&nbsp;osobu, ktor\u00e1 poskytla pomoc pri zis\u0165ovan\u00ed inform\u00e1ci\u00ed, ktor\u00e9 s\u00fa obsahom ozn\u00e1menia, na&nbsp;osobu, ktor\u00e1 je vo vz\u0165ahu k&nbsp;oznamovate\u013eovi osobou bl\u00edzkou, alebo na&nbsp;osobu , ktor\u00e1 je zamestnancom alebo kolegom oznamovate\u013ea.<\/p>\n<h2>\u010eal\u0161ie kan\u00e1ly a&nbsp;mo\u017enosti na&nbsp;podanie ozn\u00e1menia o&nbsp;poru\u0161ovan\u00ed<\/h2>\n<p>Ozn\u00e1menie mo\u017eno pri splnen\u00ed z\u00e1konn\u00fdch podmienok poda\u0165 aj prostredn\u00edctvom extern\u00e9ho oznamovacieho syst\u00e9mu Ministerstva spravodlivosti a\/alebo priamo u&nbsp;pr\u00edslu\u0161n\u00e9ho org\u00e1nu verejnej moci, tj u&nbsp;Pol\u00edcie SR, prokurat\u00fary a\/alebo u&nbsp;vecne pr\u00edslu\u0161n\u00fdch org\u00e1nov \u0161t\u00e1tnej spr\u00e1vy pod\u013ea ich p\u00f4sobnosti (napr. \u010cesk\u00e1 in\u0161pekcia \u017eivotn\u00e9ho prostredie, \u00darad pre ochranu osobn\u00fdch \u00fadajov a&nbsp;pod.).<\/p>\n<p>V&nbsp;tomto pr\u00edpade ozn\u00e1menie prij\u00edma, pre\u0161etruje a&nbsp;posudzuje Ministerstvo spravodlivosti alebo in\u00fd
